Terms and Conditions

Introduction These Terms and Conditions ("Terms") govern your access to and use of the Site, as well as all purchases made through it. By using the Site or placing an order, you accept and agree to be bound by these Terms. If you do not agree, you must refrain from using the Site and our services.

Definitions "Client" means any individual or entity purchasing Products from the Site. "Product(s)" means all items offered for sale, including customized photo albums and related goods. "Order" means the purchase of Products placed via the Site. "Intellectual Property" means all content, illustrations, designs, trademarks, texts, images, logos, graphics, photographs, and other works created or owned by Souvence.

Eligibility and Store Terms By agreeing to these Terms, you confirm that you are at least 18 years old or, if underage, that you have the consent of a parent or legal guardian. You agree not to use the Site or Products for unlawful purposes and not to copy, reproduce, duplicate, resell, or exploit any part of the Site or its content without our prior written consent. Any breach of these obligations may result in the termination of your access and legal proceedings.

Orders and Payments Orders are confirmed only once full payment has been received. A confirmation email will serve as proof of your Order and your invoice, in accordance with Articles L213-1 and L111-1 of the French Consumer Code. We reserve the right to refuse or cancel Orders in cases of suspected fraud, technical errors, stock unavailability, or non-payment. All prices are in EUR and include VAT where applicable. Payments are processed via Shopify Payments, Stripe, or PayPal.

Intellectual Property All designs, illustrations, covers, and creative elements of Souvence products are the exclusive property of Souvence. Unauthorized reproduction, distribution, modification, adaptation, transmission, or exploitation, whether partial or total, is strictly prohibited. Any infringement may result in civil and criminal liability under applicable French law (Articles L335-2 and L335-3 of the French Intellectual Property Code) and international copyright treaties. Souvence reserves the right to claim damages, interest, and legal costs in case of unauthorized use. Infringements may lead to immediate legal action without further notice.

Limitation of Liability Our liability in connection with any Product shall not exceed the purchase price paid by the Client. We shall not be liable for indirect, incidental, or consequential damages, including loss of profits, business, or data, except where mandatory consumer protection laws applicable in the Client's country of residence require otherwise, in particular the provisions of the French Consumer Code regarding legal guarantees.

Data Protection and Privacy We process personal data in accordance with our Privacy Policy, the EU General Data Protection Regulation (GDPR), and the French Data Protection Act (Loi Informatique et Libertés). By using the Site, you consent to our data practices, which include storage of transaction data, cookies, and communication for order fulfillment.

Quality Guarantee All Souvence products are covered by a 2-year quality guarantee from the date of receipt, without prejudice to the legal guarantee of conformity (Articles L217-3 to L217-20 of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code). This guarantee covers manufacturing defects, including printing quality, binding integrity, and materials. It does not cover normal wear and tear, accidental damage, damage resulting from improper use, or minor colour variations caused by differences in screen calibration (which are inherent to the printing process and are not considered defects). To activate the guarantee, contact us at lisa@souvence.com with a description and photos of the defect. If the defect is confirmed, we will send you a replacement at no additional cost. Refunds are issued within 14 business days via the original payment method where a replacement is not possible.

Returns and Defective Goods Due to the personalized nature of our Products, returns are not accepted, except in cases of proven manufacturing defect. In such cases, we will reproduce and resend the Product at no additional cost. Clients must notify us of defects within 30 days of receipt. This is without prejudice to the consumer's statutory rights under the legal guarantee of conformity, which allows the consumer to request repair or replacement within 2 years of delivery.

Right of Withdrawal In accordance with Article L221-18 of the French Consumer Code, consumers residing in the European Union have the right to withdraw from a contract within 14 days of receiving their order without giving any reason. However, pursuant to Article L221-28 (12°), this right does not apply to goods that are clearly personalised or made to the consumer's specifications. Since all Souvence products (photo albums) are custom-made based on photos and content uploaded by the customer, they are expressly excluded from the right of withdrawal. By confirming your order, you acknowledge and accept this exclusion.

Force Majeure We are not liable for delays or failures resulting from events beyond our control, including strikes, natural disasters, government actions, or internet failures, in accordance with Article 1218 of the French Civil Code.

Governing Law and Jurisdiction These Terms are governed by French law. Any dispute shall be resolved exclusively before the competent courts of Paris, France. As an EU-based B2C seller, we also comply with mandatory consumer rights applicable in the Client's country of residence, in accordance with Regulation (EC) No 593/2008 (Rome I), which ensures that consumers are not deprived of the protection afforded to them by the mandatory rules of their country of habitual residence.

    In accordance with Article L612-1 of the French Consumer Code, consumers residing in France may refer free of charge to a consumer mediator in the event of an unresolved dispute with Souvence. The mediator we have designated is:
